These Terms & Conditions apply to your use of our website and to any orders placed through www.skillioworld.com.

Please read these terms carefully before using our website or placing an order. By using our website or placing an order, you agree to these Terms & Conditions.

In these terms, “Skillio”, “we”, “us” and “our” means Skillio World Ltd. “You” and “your” means the customer, purchaser or website user.


2. About these terms

These terms apply to:

  • Use of our website;
  • Purchases made directly through www.skillioworld.com;
  • Skillio Founder Drop products;
  • Skillio Stick It! standard game packs;
  • Referral programmes, promotions and competitions run by Skillio; and
  • Customer reviews, testimonials and user content submitted to or shared with Skillio.

If you buy Skillio products through a retailer, marketplace, social media shop or third-party platform, that purchase may also be subject to that retailer’s or platform’s own terms, delivery policy and returns process.


3. Information before you buy

Before you place an order, we will show you key information about the product, including the product description, price, delivery charges, payment options and any estimated delivery or dispatch information.

Please check your order carefully before submitting it. You can check and correct errors in your basket and checkout before placing your order.

The total price payable, including the product price, VAT where applicable and delivery charges, will be shown before you place your order.


4. Our products

Skillio sells gymnastics-themed card game products, including:

  • Skillio Stick It! standard game packs; and
  • Skillio Founder Drop products, where available.

The Founder Drop is a limited early-access launch product created for early supporters. It may include the Skillio Stick It! game pack and selected extras such as a keyring, small sticker, pouch, autograph/message card, rubber wristband and packaging filler.

Product contents will be shown on the relevant product page. Products are available while stocks last.


5. Use of our website

If you create an account, you are responsible for keeping your login details secure and for all activity under your account. You must not transfer, sell, assign or allow another person to use your account. You must make sure all account, billing, payment and delivery information you provide is accurate, current and complete.

Our website and checkout are intended for use by adults aged 18 or over.

If you are under 18, you should only use our website with the involvement and consent of a parent or guardian. Purchases must be made by an adult.

You must not misuse our website. This includes:

  • Using the website fraudulently;
  • Attempting to interfere with the website or its security;
  • Copying, scraping or extracting website content without permission;
  • Submitting false, misleading or harmful information;
  • Using automated systems, bots or scripts to access the website;
  • Attempting to abuse discounts, referrals or promotions; or
  • Using the website in a way that may damage Skillio, our customers, our brand or our systems.

We may suspend, restrict or refuse access to our website if we believe these terms have been breached.


6. Product descriptions, images and availability

We do our best to make sure product descriptions, images, prices and availability are accurate.

Product images are for guidance only. Colours, finishes and packaging may appear slightly differently depending on screen settings, lighting, production batches or photography.

All products are subject to availability. We may limit quantities, withdraw products, correct errors, or cancel orders where necessary.

This may include where:

  • A product is unavailable;
  • There has been a genuine pricing error;
  • There is an error in the product description or availability;
  • There is a technical issue;
  • Payment is not authorised;
  • We suspect fraud;
  • A discount code or referral reward has been misused;
  • Delivery details are incomplete or incorrect;
  • The order appears to be for unauthorised resale; or
  • These terms have been breached.


7. Age suitability and safety

Skillio Stick It! is intended for players aged 7+.

Products may contain small parts and are not suitable for children under 3 years.

You must follow all safety warnings, rules and instructions included with the product and on the packaging.

Skillio Stick It! Can include active movements designed for fun physical play. It is not gymnastics coaching, medical advice, fitness advice, safety training, or a substitute for instruction from a qualified professional.

The following safety wording applies when playing:


Safety & Important Information:

This is an active movement game designed for fun physical play. Adult supervision is required at all times. Players should only attempt movements appropriate to their age, physical ability, and prior experience. This game does not teach gymnastics skills. Movements should only be attempted if the player already knows how to perform them safely and should not be attempted for the first time during gameplay. Players may always choose to skip a movement and draw two cards instead - no movement is mandatory. Play in a clear, open space away from furniture, preferably on a soft surface such as a mat, carpet, or grass. Some movement cards are more challenging than others and should only be attempted if the player is confident of performing them safely. Stop playing immediately if any pain, dizziness, or discomfort occurs. Players with injuries, medical conditions, or physical limitations should not participate without guidance from a qualified professional.

Important Notice and Disclaimer

Movements within this game may be physically challenging and carry with them risks that we cannot entirely eliminate. These include the risk of personal injury.

When playing this game:

  • You must act responsibly and sensibly at all times.
  • You must not participate if you are pregnant or under the influence of alcohol or non-prescription drugs.
  • You must follow all safety warnings and instructions for safe use included with the game so as not to hurt or injure yourself or others.

In the absence of any negligence or other breach of duty by us, participation in this game is entirely at your risk.

Some movement cards may be more advanced than others. No movement is mandatory. If a player is not confident, does not have enough space, or cannot perform a movement safely, they should skip the movement and follow the alternative gameplay instruction.


8. Product safety notices and recalls

If we need to contact customers about an important product safety notice, update, correction, warning or recall, we may use the contact details provided with your order.

You must follow any product safety notices, updates or recall instructions that we issue.


9. Orders

Orders are placed through our website checkout or through other approved sales channels.

When you place an order, you are making an offer to buy the products in your basket.

After placing an order, you may receive an order confirmation email. This confirms that we have received your order. It does not necessarily mean that your order has been accepted.

We reserve the right to refuse or cancel an order where necessary, including for the reasons listed in section 6.

Payment is usually taken at checkout.


10. Order acceptance

Your order is accepted when we confirm acceptance, dispatch the product, or otherwise begin processing the order for fulfilment.

If we cannot accept your order, we will let you know and refund any amount paid.

 

11. Founder drop and early-access launch windows

The Skillio Founder Drop is a limited early-access launch product for early supporters.

Founder Drop products are available while stocks last. Access to an early launch window does not guarantee that stock will remain available.

Founder Drop orders will be fulfilled in the order we process them, subject to stock availability, successful payment and verification.

Estimated dispatch timings will be shown on the relevant product page, checkout page or order information. Any dispatch date or delivery window is an estimate only and is not guaranteed.

Delivery may be affected by fulfilment times, courier delays, operational issues, stock processing, customs, public holidays or circumstances outside our reasonable control.


12. Prices, VAT and delivery charges

Prices are shown on the website and may change from time to time.

Prices include VAT where applicable unless stated otherwise.

Delivery charges are shown separately at checkout before you place your order.

If a pricing error is obvious or could reasonably have been recognised as an error, we may cancel the order and refund any amount paid.

Discount codes, offers and referral rewards may be subject to additional terms. We may withdraw, refuse or cancel a discount code or offer if we believe it has been misused.


13. Payment

We accept the payment methods shown at checkout.

Payments may be processed by third-party payment providers. Those providers may have their own terms, conditions and privacy policies.

Your order will only be processed once payment has been authorised.

We do not currently offer buy-now-pay-later unless this is specifically shown at checkout.


14. Delivery


We deliver to the locations shown at checkout. We may offer UK and international delivery depending on availability.

Delivery timeframes are estimates only unless we clearly state otherwise. We are not responsible for delays caused by couriers, customs, incorrect delivery information, failed delivery attempts, weather, public holidays, strikes or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. If an order is returned to us or needs to be re-sent because the address was incorrect or incomplete, you may need to pay additional delivery charges.

Risk in the product passes to you when the product is delivered to the address you provided.

Ownership of the product passes to you once we have received full payment.


15. International orders, customs, duties and taxes

International delivery may be available in selected countries.

If you order from outside the UK, you are responsible for any import duties, taxes, customs charges, handling fees or local charges that may apply.

We are not responsible for delays caused by customs checks, import processes or local delivery providers.

We may restrict or refuse delivery to certain countries or regions.


16. Your right to cancel

If you are a UK consumer buying online, you have the right to cancel your order within 14 days after the day you receive your goods, without giving a reason. 

After telling us you want to cancel, you have a further 14 days to return the goods to us. 

Returned products should be unused, complete and returned with all original packaging, accessories, inserts and extras.

Please include:

  • Your name;
  • Your order number;
  • The product you want to return; and
  • Your contact details.


17. Returns and refunds

For change-of-mind returns, you are responsible for the cost of returning the product to us unless we agree otherwise.

Returned products should be unused, complete and returned with all original packaging, accessories, inserts and extras.

You may inspect the product as you would in a shop. However, if a product has been opened, used, damaged, marked, made incomplete, mixed with other items, or handled more than necessary, we may reduce the refund to reflect any loss in value where legally allowed. UK guidance allows deductions where an item has been used or damaged. 

We will refund the product price and the standard delivery charge you paid, where required by law. If you selected a more expensive delivery option, we only need to refund the cost of standard delivery. 

We will refund you within 14 days of receiving the returned product, or receiving evidence that you have sent it back. 

Refunds will be made to the original payment method where possible.

We will provide the correct returns address after you contact us. Please do not send products back without contacting us first, as this may delay your refund or replacement.

This returns policy does not affect your statutory rights.


18. Products that may not be eligible for cancellation

Some products may not be eligible for cancellation or return where the law allows. This may include, for example:

  • Personalised products;
  • Products made to your specification;
  • Digital products once access or download has started, where applicable; or
  • Other products excluded by law.

For current Skillio physical card game products, your statutory cancellation rights apply unless a legal exception applies.


19. Damaged, faulty, missing or incorrect items

If your order arrives damaged, faulty, incomplete or incorrect, please contact us as soon as possible at: hello@skillio.com

Please include your order number, a description of the issue and, where helpful, photos of the product, packaging or missing/damaged item.

Please tell us within 7 days where possible so we can resolve the issue quickly. This does not affect your statutory rights.

Where an item is confirmed to be faulty, damaged, missing or incorrect, we may offer a replacement, replacement part, missing item, repair, refund or other suitable solution depending on the issue.

If a card is misprinted, missing or damaged inside a sealed game pack, we will aim to replace the affected card or product where reasonably possible.

If a Founder Drop item such as a keyring, sticker, pouch, wristband or autograph/message card is missing, we will aim to send the missing item once the issue has been verified.

Nothing in these terms affects your legal rights if goods are faulty, not as described, or not fit for purpose.


20. Business, club and organisation purchases

Products sold through our website are mainly intended for personal, family or club use.

If you buy products on behalf of a business, club, school or organisation, you confirm that you have authority to place the order.

Consumer cancellation rights may not apply to purchases made by businesses, clubs, schools or organisations acting in a business or organisational capacity.

Clubs may purchase multiple products for members, events or club use, subject to availability and any order limits shown on the website.

Retailers, distributors and commercial partners must enter into separate written terms with Skillio World Ltd.


21. Personal use, resale and bulk orders

You must not purchase products for commercial resale without our written permission.

You may not copy, repackage, relabel, counterfeit, imitate or commercially exploit Skillio products without our written permission.

We may refuse or cancel orders that appear to be for unauthorised resale.


22. Referral programme

We may operate referral programmes for families, clubs or other groups.

Referral rewards may include early access, bonus content, physical rewards, prize entries or other benefits. The reward tiers may vary between campaigns.

Referral rewards are subject to availability and verification. No cash alternative is available.

We may remove or refuse referrals that we believe are fake, duplicated, self-generated, automated, misleading, fraudulent, or otherwise in breach of the spirit of the programme.

We may change, pause, withdraw or end a referral programme at any time. Where possible, we will try to honour genuine rewards already earned, but rewards remain subject to availability.

Club-related rewards may require us to verify the club name, contact details, referral source and eligibility.


23. Promotions, competitions and giveaways

We may run promotions, competitions, prize draws or giveaways through our website, email, social media or other channels.

Each promotion may have its own additional terms. If there is any conflict between these general terms and the specific promotion terms, the specific promotion terms will apply.

Unless stated otherwise:

  • Entrants under 18 must have parent or guardian permission;
  • No cash alternative is available;
  • Prizes are subject to availability;
  • We may substitute a prize with an alternative of equal or greater value where necessary;
  • We may disqualify entries that are incomplete, fraudulent, automated or in breach of the rules; and
  • Social media platforms such as Instagram, TikTok, Facebook or YouTube are not responsible for our promotions.

Some promotions may be limited to certain countries or regions.


24. Reviews, testimonials, customer content and feedback licence

You may be able to leave reviews, feedback, comments or other content on our website or through third-party review platforms.

By submitting a review or testimonial, you confirm that it is honest, accurate and based on your own experience.

You must not submit:

  • Fake reviews;
  • Reviews on behalf of someone else;
  • Reviews designed to mislead customers;
  • Reviews that hide a commercial relationship;
  • Incentivised reviews without proper disclosure;
  • Offensive, abusive or unlawful content;
  • Spam; or
  • Content that infringes someone else’s rights.

We may use customer reviews and testimonials in our marketing, website, social media, advertising and promotional materials.

We may remove or refuse reviews or content that we believe are fake, offensive, unlawful, misleading, irrelevant, abusive, spam, inappropriate, or otherwise in breach of these terms.

If you send us ideas, suggestions, feedback, proposals, game ideas, card ideas, product ideas, improvements or other submissions, you agree that we may use them without restriction or payment to you, provided we do not use your personal data except in line with our Privacy Policy. You confirm that you have the right to send us the feedback and that it does not infringe anyone else’s rights.


25. Intellectual property

All intellectual property rights in Skillio, including our name, logo, trademarks, card designs, artwork, rules, characters, packaging, website content, images, videos, text, product concepts and marketing materials belong to Skillio World Ltd or our licensors.

You must not copy, reproduce, modify, distribute, sell, counterfeit, imitate, exploit or use Skillio intellectual property without our written permission.

You may share photos or videos of genuine Skillio products for personal, non-commercial use, including on social media, provided you do not suggest that you are officially associated with Skillio unless we have agreed this in writing.


26. Third-party websites, apps, retailers and services

Our website may link to third-party websites, apps, retailers, platforms or services, including payment providers, social media platforms, email platforms, referral platforms, review platforms, fulfilment providers, retailers or partners.

We are not responsible for third-party websites, apps, services, content, policies or terms.

If you buy Skillio products from another retailer, marketplace, social media shop or platform, that purchase may be subject to that retailer’s own terms, delivery policies and returns process.

These Terms & Conditions apply to purchases made directly through www.skillioworld.com, unless stated otherwise.


27. Privacy and marketing

Your personal information will be handled in accordance with our Privacy Policy.

We may collect information such as your name, email address, delivery address, billing details, order details, club name, referral information and marketing preferences.

You may receive order-related emails about your purchase. You will only receive marketing emails where we have permission to send them or where the law allows.

You can unsubscribe from marketing emails at any time by using the unsubscribe link in our emails or contacting us at: hello@skillio.com


28. Our liability

Nothing in these terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation;
  • Breach of your statutory rights; or
  • Any other liability that cannot legally be limited or excluded.

Subject to the above, we are not responsible for:

  • Unsafe use of the product;
  • Failure to follow the rules, safety warnings or instructions;
  • Movements attempted for the first time during gameplay;
  • Movements attempted without proper space, supervision or ability;
  • Injuries caused by reckless, unsuitable or unsafe activity;
  • Losses that were not reasonably foreseeable;
  • Business losses, loss of profit or loss of opportunity;
  • Loss caused by use of the product for commercial, professional, coaching or instructional purposes without our written agreement; or
  • Delays or failures caused by events outside our reasonable control.

Where legally permitted, our total liability to you is limited to the amount you paid for the product giving rise to the claim.


29. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control.

This may include courier delays, customs delays, strikes, transport disruption, supply chain issues, extreme weather, technical failures, payment provider issues, changes in law, accidents, or other events beyond our control.


30. Changes to these terms

We may update these Terms & Conditions from time to time.

The terms in force at the time you place your order will apply to that order.

Please check these terms before placing an order.

 

31. Termination or suspension

We may suspend or terminate your access to the website, your account, referral participation, promotional participation or any part of our services if we believe you have breached these terms, misused the website, acted fraudulently, abused referrals or promotions, or used Skillio services in a way that may cause harm to Skillio, Shopify, our customers or other users.

If your access is suspended or terminated, any rights or obligations that should continue after termination will continue, including sections relating to intellectual property, customer content, liability, privacy, payment obligations, governing law and any other terms that by their nature should continue.


32. If part of these terms Is invalid

If any part of these terms is found to be unlawful, invalid or unenforceable, the rest of the terms will continue to apply.


34. Waiver and entire agreement

These terms, together with any policies linked from them, form the agreement between you and Skillio World Ltd for use of our website and purchases made directly from us.

If we do not immediately enforce a right under these terms, this does not mean we have waived that right. We may still enforce that right later.


34. Transfer of our rights

We may transfer our rights and obligations under these terms to another organisation. If this happens and affects your rights, we will let you know where required.

You may only transfer your rights or obligations under these terms to another person if we agree in writing.


35. Headings

Section headings are included for convenience only and do not affect the interpretation of these terms.


36. Governing law and disputes

These terms are governed by the laws of England and Wales.
